FUNCTIONAL RESPONSIBILITIES
Ensure Guangzhou Branch and units within the designated compliance network comply with rules, guidelines, directives and regulations set forth by local authorities / country regulators by:
Acting as principal interface between government authorities, e.g. PBOC, CRBC & Ministry of Labor, and the Bank, keeping abreast of all relevant changes to compliance requirements applicable to Branch business activities and practices; assessing their impact and advising operating management for effecting necessary courses of action in the execution of Bank’s procedures and compliance program;
Coordinating with regulators and operating departments with onsite / offsite inspection / examination / review activities, liaising the timely and effective resolution of issues thus raised;
Attending meetings, seminars and courses with respect to applicable regulations and directives, ensuring good understanding and comprehension of the relevant requirements to enable Branch’s full and ongoing compliance;
Coordinating and assisting Management in responding to enquires from regulators and government authorities.
Ensure Guangzhou Branch complies with all applicable internal policies and procedures by:
Coordinating the completion / conducting of compliance activities as outlined in the Bank Compliance Handbook;
Documenting local specific compliance processes, in particular the Legislative Compliance Matrix which serves as the key control document for monitoring various compliance activities, ensuring it is up to date and effectively implemented in the Branch;
Coordinating the completion of necessary reporting and compliance reviews, e.g. annual certification on compliance with Business Conduct and Compliance Risk Management Report;
Reviewing of activities associated with new products, programs or business initiatives;
Coordinating the delivery of training / educating programs relevant to Branch operation and local regulatory compliance;
Conducting specific transactions review as assigned by Branch Manager. In doing so, the Compliance Officer ensures that (a) an appropriate checklist is maintained and (b) associated procedures and findings are documented;
Maintaining effective liaison with other country compliance, Regional and EO Compliance personnel.
Serve as the Branch’s Anti Money Laundering (AML) Compliance Officer and undertake the responsibilities of:
Ensuring branch staff are fully aware of and adhering to the Bank’s AML / ATF policies and Know Your Customer (KYC) procedures;
Reviewing new customer account documentation to satisfy that the necessary due diligence has been performed by the responsible account opening staff, bringing any exceptions to the attention of Branch Manager;
Performing review of customer profiles, identify accounts which are classified “high risk”, ensuring the respective assessments are appropriately conducted, escalated to the appropriate authority for review / confirmation in accordance with Bank’s procedures/guidelines;
Acting as a focal point for receiving / collating data, source of funds and making the respect reports on suspicious activities / significant transactions per Bank policy, as well as local regulations;
Ensuring that local regulatory requirements are adequately covered by the Bank’s AML / ATF Handbook. Otherwise develop the necessary supplementary program and obtain approval from Regional / EO Compliance for implementation.
