RESPONSIBILITY
If tasked, analyze customer specifications in the bid stage to identify commercial-related risks and opportunities to ensure that tenders and finalized “as sold” agreements are comprised of sound terms and conditions.

Prepare and follow up Contract Abstract to ensure contractual commitments and entitlements are not missed and prime contract requirements are properly flown down into partner and subcontracts.

Prepare contract documents required prior to contract award and throughout contract execution. Oversee control of all contract documents for customer, consortium and subcontracts.

Review language of parent company guarantees and bonding arrangements as required. Work with Finance Department in the establishment of financing arrangements and preparation of such documents as releases, letters of credit, waiver of liens and affidavits that enable payment collection.

Provide counsel and recommendations to the Project Manager and other functional Project Team members regarding contractual and commercial implications of potential project strategies and decisions. Reviews external communication to avoid self-implication and acceptance of unnecessary liability. Knows when to consult with Legal Department and manages the legal interface if required.

Provide on-going proactive monitoring, reporting and assessment of project strategies and performance compared to “as sold” contract terms and conditions in order to successfully manage project risks and capitalize on opportunities. Ensure that proper and timely contractual notices are issued to customers, partners and subcontractors. Recommend responsive action plans. Assist Project Manager in tracking and managing issue resolution.

Manage administration of project change process including the project field office ensuring required justification, review, approvals, and documentation of authorized changes. Review of all project invoices for contractual compliance and entitlement.

Lead the establishment and negotiation of commercial positions pertaining to such matters as price changes, contract extras, differing site conditions, scope ownership issues, time extensions, escalation, force majeure, back charges, warranty, surety as well as insurance claims and letter of credit calls. Maintain claim register and proper contemporaneous claim records. Plan and execute claims management strategies and actions to achieve targeted recoveries per plan. Is responsible for driving commercial close out of all PowerSolve issues.

REQUIREMENTS
Master of Law preferable otherwise in Engineering or Commercial-related discipline. MBA is desirable.
法学硕士学历优先,工程技术或者商务相关专业亦可,MBA学历尤佳。
New Graduates acceptable with Master of Law otherwise 8 years experience in heavy industry, long-cycle global project execution business, preferably in the fossil power generation industry. Experience in Commercial Management on executing projects preferable.
应届法学硕士毕业生亦可, 或重工业领域8年商务经验,长期进行涉外项目执行,火电行业尤佳。具有当前项目合同管理经验者优先.
Proven commercial acumen in the establishment of sound contract terms and conditions, coupled with very competent analytical, negotiation and risk management skills.
拥有丰富的订立商业合同的经验,并有充足的分析,谈判及风险管理能力
Strong planning and organizational expertise. Team player, with excellent communication and interface skills
计划及组织能力强,优秀的沟通和合作能力
Chinese mother language/ English reasonable in writing and speaking.;
